This is a morally and legally binding agreement. Payments are non-refundable. A $10 late fee will be charged for payment not received, or unable to be processed, by each installment due date.

This End User License Agreement (“EULA”) is a legalagreement between you and I Feel Like A Million BucksLLC, governing the license and use of the audio contentowned or licensed by I Feel Like A Million Bucks LLC andmade available for purchase on this website (collectively,the “Recordings”). All use by you of the Recordings isgoverned by this EULA.
Please read the EULA carefully, because it is a legalcontract and imposes obligations on you as a user of theRecordings.

Subject to the terms and conditions andfor the limited purposes set forth herein, I Feel Like A MillionBucks LLC grants you the limited and non-transferable,right and license to: (i) download the Recordings you havepurchased from this website and listen to the Recordings ondevices owned by you; and/or (ii) listen to the compact disccontaining the Recordings you purchased from this websiteon devices owned by you.
2.2 Ownership. You hereby acknowledge that nothing in thisEULA is meant or shall be deemed to give you any rights inany works of authorship or copyrights owned or licensed by IFeel Like A Million Bucks LLC. In the event that the owner, inwhole or jointly, of the Recordings is a party other than I FeelLike a Million Bucks LLC, you agree that such party shall bea third party beneficiary under this EULA and shall have theright to enforce the terms and conditions of this EULA thatpertain to such party’s rights in and to the Recordings as ifsuch party were a party to this EULA.
2.3Restrictions. The following restrictions shall apply to youruse of the Recordings in any format and on any media:
(a)You may not copy or reproduce any portion of theRecordings.
(b)You may not distribute, share through any information
network, transfer, sell, lease, or rent any of the Recordingsto any other person or entity, in whole or in part.
(c)You may not change, alter, modify, or create derivativeworks, enhancements, extensions, or add-ons to any of theRecordings.
(d)You may not decompile, reverse engineer, ordisassemble any of the Recordings, in whole or in part.
(e)You may not use the Recordings for commercialpurposes, or purposes other than your personal use andenjoyment.

I Feel Like a Million Bucks LLC DISCLAIMSALL WARRANTIES THAT RELATE IN ANY WAY TO THERECORDINGS, THE CONTENT OR ANY PORTIONSOR COMBINATIONS THEREOF, EITHER EXPRESSOR IMPLIED, INCLUDING WITHOUT LIMITATION ANYWARRANTY FOR INFORMATION, AVAILABILITY,ACCURACY, ADEQUACY, QUIET ENJOYMENT, NON-INFRINGEMENT, MERCHANTABILITY, OR FITNESS FORA PARTICULAR PURPOSE.
5.2Indemnity. You shall defend, indemnify, and holdharmless I Feel Like A Million Bucks LLC and its employeesand agents, from and against any and all suits, proceedings,claims, losses, and damages (including reasonableattorneys’ fees) related to: (i) any breach by you of thisEULA, and (ii) any claim by a third party that arises fromyour use or misuse of the Recordings.
5.3 Limitation of Liability. IN NO EVENT SHALL I Feel Like aMillion Bucks LLC OR ITS OFFICERS, DIRECTORS,AGENTS, OR LICENSORS BE LIABLE TO YOU FORSPECIAL, EXEMPLARY, OR CONSEQUENTIALDAMAGES ARISING OUT OF OR IN CONNECTION WITHTHIS EULA OR YOUR USE OF OR INABILITY TO USETHE RECORDINGS, INCLUDING BUT NOT LIMITED TOLOST PROFITS, LOSS OF DATA, AND ERRORS OROMISSIONS IN CONTENT, REGARDLESS OF THE FORMOF ACTION, WHETHER I Feel Like a Million Bucks LLCKNEW OR SHOULD HAVE KNOWN OF THE POSSIBILITYOF SUCH DAMAGES. THE TOTAL LIABILITY OF I FeelLike a Million Bucks LLC, IF ANY, ARISING OUT OF OR INCONNECTION WITH THIS EULA OR YOUR USE OF ORINABILITY TO USE THE RECORDINGS SHALL NOTEXCEED IN THE AGGREGATE THE FEES ACTUALLYPAID BY YOU FOR THE APPLICABLE RECORDINGS.THE PROVISIONS HEREIN CONCERNING LIMITATIONSOF LIABILITIES AND DAMAGES ALLOCATE THE RISKSOF THIS AGREEMENT BETWEEN THE PARTIES. I Feel Like aMillion Bucks LLC DOES NOT GUARANTEE, REPRESENT,OR WARRANT THAT (I) THE RECORDINGS WILL BE
ERROR-FREE, ACCURATE, OR CURRENT, OR (II) YOURUSE OF THE RECORDINGS WILL BE UNINTERRUPTED,ERROR-FREE, OR FREE FROM LOSS CORRUPTION,ATTACK, VIRUSES, INTERFERENCE, HACKING, OROTHER SECURITY INTRUSION, AND DISCLAIMS ANYLIABILITY RELATING THERETO.
ARTICLE 6: MISCELLANEOUS
6.1 Choice of Law. This EULA shall be governed by the lawsof the State of Washington (regardless of the laws that mightotherwise govern under applicable Washington principlesof conflicts of law) as to all matters, including but not limitedto matters of validity, construction, effect, performanceand remedy. King County, Washington shall be the properplace of venue for all suits to enforce this EULA, and anylegal proceedings to enforce the provisions hereof shall bebrought in the Superior Courts of King County, Washington,or in the United States District Court for the Western Districtof Washington.
6.2 Severability. The invalidity or unenforceability ofany provision of this EULA shall not affect the validity orenforceability of the remaining provisions, and this EULAshall be construed as if such invalid or unenforceableprovisions were omitted, unless the omission of suchprovision would deprive one of the parties of a materialbenefit of its bargain hereunder.
6.3Assignment. You may not assign this EULA. Anyassignment made in contravention of this provision shall benull and void for all purposes.
6.4 Binding Effect. This EULA shall be binding on and inureto the benefit of the parties and their respective successors
and permitted assigns.
6.5Entire EULA. This EULA constitutes the entire EULAand understanding of the parties hereto in respect of thesubject matter contained herein and supersedes all prioragreements, consents and understandings relating to suchsubject matter.
ARTICLE 7: REGISTRATION AND ACCEPTANCE.
By downloading, listening to, or otherwise accessing theRecordings, you represent and warrant that you are 18years of age or older, capable of entering into a binding legalagreement, and have read, understand, and agree to bebound by all provisions of this EULA. For purposes of thisEULA, the “Effective Date” shall mean the date on which youfirst accepted this EULA by ordering any product(s) from this website.
